Creative financing

Sell for more by getting paid over time

When a cash sale doesn’t pencil out, flexible terms often do. You get a higher price, I get a workable deal, and everything is secured at a title company.

Plain English

What "creative financing" actually means

Most people think a house sells one way: a buyer brings cash (their own or a bank’s), you get a check, done. Creative financing just means the money moves differently. Instead of everything on closing day, part or all of the price is paid over time, or I take over the loan you already have.

This is not new or exotic. Sellers have carried financing for generations. It simply isn’t something the average agent brings up, because it doesn’t fit a standard listing.

Three common structures

Which one fits depends on your loan, your equity, and what you need

Seller financing

You become the bank. I pay a down payment, then monthly payments with interest until the balance is paid. You hold a recorded lien on the house for protection.

Good fit when: the house is paid off or nearly so, you want monthly income, or you want to spread out capital gains.

Subject-to

I take over your existing mortgage payments and the deed transfers to me. The loan stays in your name until paid off or refinanced, with safeguards so you can confirm every payment is made.

Good fit when: you owe close to what the house is worth, you are behind or about to be, or you have a great low interest rate.

Lease option

I lease the property from you with the right to buy at an agreed price later. You keep the title and receive rent until I exercise the option.

Good fit when: you want to keep the asset a while longer but stop managing it, or timing needs to be flexible.

Example

Why terms can beat cash

Say a house would sell for $400,000 fixed up and you owe $360,000. A cash buyer has to subtract repairs, costs, and margin, so a cash offer might land around $320,000. That doesn’t even cover your loan.

With a subject-to purchase, I take over the $360,000 loan, give you some cash for your equity and moving costs, and you walk away with money in hand and no foreclosure risk. Same house, completely different outcome.

Numbers are illustrative only. Every property is different.

Protections

How you stay protected

  • Every closing happens at a Utah title company with recorded documents.
  • Attorney-drafted notes, deeds of trust, and agreements. Not internet templates.
  • Third-party loan servicing available so payments are tracked and verified.
  • You are encouraged to have your own attorney or CPA review everything. I’ll wait.
  • If I stop paying, you have legal recourse to take the property back.

Creative financing questions

Is this safe for me as the seller?

Yes, when it is done properly. Every deal closes at a title company with attorney-drafted documents. With seller financing you hold a recorded lien on the property, the same protection a bank has. If I stop paying, you can take the house back.

What if I still have a mortgage?

That is often where creative terms shine. A "subject-to" purchase means I take over your existing payments and the loan gets paid down (or paid off) on schedule. We put protections in place so the payments are made and you can verify it.

Why would I want payments instead of cash?

Three common reasons: you owe close to what the house is worth so a cash sale leaves you with little or nothing; you would rather have monthly income than a lump sum; or your CPA says spreading the gain over several years lowers your taxes.

Can I get some cash at closing too?

Usually. Most creative deals include a down payment, and the amount is negotiable.

I am not an attorney, CPA, or financial advisor. Talk to yours about how any of these structures affect your taxes and situation.
